Notice: This document describes AXORYN Technology's practices for the site axoryn.tech, the Virtual Classroom aula.axoryn.tech, and associated digital services. It has been drafted in line with international data protection and digital consumer principles (GDPR/EU, Law 29733 – Peru, and ISO/IEC 27701 good practices). It does not replace personalized legal advice; for specific cases contact contacto@axoryn.tech.
All contracting of courses, simulator licenses, or services through axoryn.tech and aula.axoryn.tech is entered into with Axoryn Technology LLC, which issues the corresponding payment receipts.
1. Acceptance of the Terms
By accessing axoryn.tech or aula.axoryn.tech, creating an account, purchasing a course or a simulator license, or checking the acceptance box on the purchase forms, you (the "User") declare that you have read and accepted these Terms, the Privacy Policy, and the Returns Policy.
If you do not agree, do not use the services.
2. Description of the service
AXORYN offers:
Digital training products: courses in the Virtual Classroom and certification exam simulators (PMP, Scrum, CompTIA, Six Sigma, PRINCE2, among others available).
Professional services: Governance, Risk and Compliance (GRC) consulting, subject to specific proposals and contracts.
The simulators are academic preparation tools. They are not necessarily affiliated with or endorsed by the certifying bodies (PMI, Scrum.org, CompTIA, PeopleCert, IASSC, etc.), unless expressly stated. Passing a simulator does not guarantee passing the certifying body's official exam.
3. Accounts and eligibility
You must provide truthful information and keep your credentials confidential.
You are responsible for all activity carried out from your account.
Accounts are personal and non-transferable, except for expressly contracted corporate plans.
AXORYN may refuse, suspend, or cancel accounts for fraud, abuse, or breach of these Terms.
4. Simulator licenses and course access
A purchase grants a time-limited license to use the product (e.g., 30 / 60 / 90 / 180 days depending on the plan), not ownership of the software or the question bank.
The license is normally tied to the student's email address (bound_email) and to the certification purchased.
Sharing, reselling, sublicensing, scraping, or redistributing the content of the question bank, flashcards, or materials is prohibited.
Once the license expires, access to the corresponding simulator ceases; history may be retained in accordance with the Privacy Policy.
5. Payments, pricing, and taxes
Prices are shown in United States dollars (US$) or another currency indicated at checkout.
AXORYN may change prices prospectively; the price paid on an already-confirmed order will not be altered.
Payment is processed through the enabled methods (payment gateway, bank transfer, or others). Activation may be conditional upon payment confirmation.
Attempt to breach security, or circumvent licenses or proctoring
Use bots, scrapers, or mass extraction of the question bank
Impersonate another identity or create multiple accounts to abuse trials or promotions
Upload malware or unlawful content
Use the service in a manner that infringes third-party rights or the law
7. Intellectual property
The platform, the "AXORYN" marks, designs, texts, question banks, explanations, software, and materials are the property of AXORYN or its licensors. Unauthorized reproduction is prohibited. Third-party materials cited for training purposes respect their trademarks; AXORYN does not claim any undue affiliation.
Regarding documents that an administrator may upload for AI-assisted generation of questions, the uploader represents that they hold the rights of use and assumes responsibility for any third-party claims.
8. Proctoring and exam rules
In the simulators, the exam may require an active camera, window focus, and a single session. Failure to comply (camera off, multiple sessions, etc.) may void the attempt with a score of zero, in accordance with the rules displayed before the exam begins. The User accepts these conditions upon starting the exam.
9. Availability, support, and changes
AXORYN strives for high availability but does not guarantee uninterrupted uptime (maintenance, force majeure, third-party failures). Support is provided through the published channels. We may improve, modify, or discontinue features with reasonable notice when the change is material.
10. Limitation of liability
To the maximum extent permitted by law:
The services are provided "as is" and "as available."
AXORYN is not liable for loss of profits, data, or indirect damages arising from use or inability to use the services, except in cases of willful misconduct or gross negligence where the law does not permit limiting such liability.
Total aggregate liability to the User for a specific incident will not, as a general rule, exceed the amount paid by the User to AXORYN in the 12 months prior for the affected product, unless mandatory law provides otherwise.
11. Suspension and termination
We may suspend or terminate access in the event of non-payment, fraud, unlawful sharing of licenses, or serious breach of these Terms, without prejudice to other legal actions. The User may request account closure by writing to contacto@axoryn.tech.
12. Governing law and disputes
Except for mandatory consumer-protection law that is more favorable to the User:
These Terms are governed by and construed in accordance with the laws of the Republic of Peru.
The parties will attempt to resolve disputes in good faith. In the absence of agreement, the courts of Lima, Peru, will have jurisdiction, without prejudice to mandatory consumer forums.
If the User resides in the EU/EEA and the consumer law of their country is mandatory, they may avail themselves of that protection.
